Legal Question in Wills and Trusts in Ohio
Deceased person/nursing home
My mother and her brother were co-joint owner of her mother's 1977 mobile home and approx 1 acre of land valued at $35,000. All 3 were in title. Her mother was in a nursing facility at the time. The Pike Cty Ohio Welfare office told my mother that while her mother was still alive, she could purchase the asset by buying out the other joint owners. The nursing home was well aware of what was going on and wanted no money from the sale. My mother received a letter from the Atty Gen'ls office wanting money from sale of the asset as well as what was in her checking acct at time of death. I believe my mother was a joint owner on the checking as well which had a balance of less than $1500. Would she owe the State of Ohio money? My mother is 77 yrs old living on a fixed income and does not have this kind of money. Would she be required to sell the old mobile home which she bought for a granddaughter and 2 small children to live in.

Re: Deceased person/nursing home
It sounds like from your question that your grandmother might have been receiving medicaid and the state is trying to recover some of the money paid out from her estate. There right to recover will depend on when the transfers were made.
Your mother should consult with an attorney who can review the situation and determine if money is owed to the State of Ohio.
