Legal Question in Wills and Trusts in Ohio

Distrubution of property after death

In October 2002 my father passed away. He owned a home with his wife (not my mother). The deed was transferred to her upon his death. She has now added her son to the deed as a second party. Upon her death do my sister and I have any rights to this property as the only surviving children of our father?

Re: Distrubution of property after death

No. The property belongs 100% to your father's wife. She can leave it to whomever she desires. You and your sister do not inherit from her, only from your father. Make sure you were not entitled to anything as the result of your father's death. You would be entitled to part of any of your father's probate property (not joint and survivorship property or property with a named beneficiary) subject to some spousal elections. Depends how large your father's probate estate was.
