Embezzlement?
My sister-in-law is the administratrix for my wife's father's estate. We are pretty sure she used her own money for a down payment to help her son buy rea estate from the estate. Is that considered embezzlement?

It could easily be a breach of fiduciary duty. It should be handled through filings with the probate court.
