Establishing a life estate

How can a "Life Estate" be established? I would like to designate a person who will have the right to reside in a dwelling I own until their death. I have named the property in a trust for my heirs and want it to revert to said heirs after the person named in the life estate is deceased or decides not to be a resident at the property.

A life estate can be established by executinig a new deed which grants the life estate. Or, you can address the bequest in your will or trust by making a codicil or amendment to the trust, assuming that it is a revocable trust.

The easiest way to grant a life estate is with a deed granting a life estate. An attorney can assist you in the preparation and execution of this deed.
