Estate in probate, no will, two sons only living kin can one reside in home while estate still in probate

Yes, if both sons/heirs agree, one son may reside in the home while the estate is still in probate. You need to establish the term under which he will reside in the home and both agree to such terms. Sometimes it is a benefit to have someone reside in the home to maintain the home and keep it safe from vandals/thieves until it can be sold or transferred.
