My brother passed away in Feb 2009. Can we file his 2008 & 2009 income taxes this year together or do we need to wait until next year to do his 2009 taxes for the 45 days he lived in 2009?

You will need to file a return for both 2008 and 2009. A return may not be needed for 2009 if your brother did not have sufficient income.
Be sure to attach an IRS form 1310 if he is due a refund.
