Ohio law permits a probate judge to deny appointment of a non resident executor unless that person is the sole beneficiary. Courts often make posting of a bond a condition the appointment of a non resident executor.

Yes, and if that person is a non-relative within the state, such as an attorney, that executor would have to get bonded.
