Legal Question in Wills and Trusts in Ohio

Can false documents be filed intentionaly in Ohio Probate Court? If so, what should I do? This involves a Last Will that states that a Trust was set up for one of two sons, but this was not done...only the one son got 100% of assets?

The intentional filing of falsified documents is certainly not permitted in Ohio probate courts. However; it sounds like your case would involve the contesting of a Will that you believe to be invalid, as opposed to falsified. There are strict time requirements in will contests in Ohio and you should pursue this matter immediatley to protect your rights. Our office has extensive experience in these types of cases. Any documents can be filed in Probate Court however, it is up to the persons with an interest in the estate to contest those documents within the time restrictions set forth by statute.
