Legal Question in Wills and Trusts in Ohio

Father died Intestate- What are my rights?

I am 36 years of age. My father lives in Ohio. He remarried 3 years ago. He died in October under queationable circumstances. His death is still under investigation. My stepmother claims they have nothing, we know this is not true. What rights do my sister and myself have as far as contacting insurance companies, military retirement, etc. for proof of his estate? If we rely only on her word, we will not get the truth. How do we proceed from here?

If you have a sibling who lives in Ohio, that person may wish to consider applying to be the Administrator of your father's estate. This will bring the matter into the Probate Court. Assuming there are any assets that must pass through probate, you and your siblings will have a better chance of discovering them.

Another thing you may wish to do is contact the probate court of any county where your father lived. It is possible that your father might have created a will and deposited it with the probate court. Probate courts act as depositories for wills where an individual wishes to ensure that the document does not become lost or destroyed. Many people (perhaps most) deposit their will with family members or their attorney, but some do take advantage of the depository with the probate court.

Do check in with an attorney, at least for an initial consultation to receive personalized advice on your particular situation. Aside from general suggestions, we cannot give specific legal advice or create a proper attorney-client relationship in this forum.
