Legal Question in Wills and Trusts in Ohio
grandchild passes away before estate settled
Myself and 4 other grandchildren are named in my grandfathers will to inherit stock along with his 2 daughters getting the bulk of the estate. The youngest grandchild has unexpectantly died in his early 20's. The estate is not yet settled. What happens to his share of the estate since the grandchild did not have a will and the estate has yet to be settled? Will this cause a problem settling the estate as well?

To get specific answers, more detail on the grandchild who passed away is needed such as when he died in relation to the grandfather, and who his family members are.
However, in general it looks as if a probate of the grandchild's estate will need to be conducted, and whoever is entitled to inherit under state law for people dying intestate will get the grandchild's share. Again, more information is needed to give details.

There should not be a problem settling this estate as long as there are no challenges to the will. The way in which the stocks will be divided among the grandchildren depends upon the way in which your grandfather had the will written up. Most likely, the result will be this: Either the stocks get divided among the remaining grandchildren or the deceased granchild's share goes to that persons' children (the greatchildren).
