Legal Question in Wills and Trusts in Ohio
Grandfathers will and how it will be distributed.
My Grandfather passed away four months ago. After attending the funeral in Ohio (travelling from Florida) we waited several weeks and then inquired to my Uncle about the existance of any will and he denied the existance of one. Now nearly 4 months later an attorney from Ohio has contacted me and sent a letter containing the will and a document to sign ''Waiver Of Notice Of Probate Of Will.'' The will names my Uncle and my Mother (deceased) as the only beneficiaries ''per stirpes.''
My question is why did it take 4 months for me to be notified?
I understand that as the only lineal descendant of my mother I am entitled to her half.
The will does not inventory any of the assets of my Grandfathers estate, and my Uncle is the executor of the estate. During the 4 months I have been notified by other family that my Grandfathers residence has been emptied and cleaned out by my Uncle. As I was close to my Grandfather I know there were many highly valuable items and documents in his residence. If my uncle has claimed all of that already do I have any recourse without knowing exactly what was there to obtain what is mine?
Also, what does the waiver form mean and should I sign it? My uncle has signed it already.

Since you were contacted by an attorney, I suggest you call that person with these questions. The attorney should be representing the estate and no single individual who might benefit from the estate, so his or her answers should be straightforward. Your questions deserve answering.
