Are there laws as to who can post an obituary?

My father just passed away and his family(whom he has not seen in 14 years)tried to post an obit in our local newspaper(FL), but the paper contacted my mother(next of kin) and she declined to submit. His siter-in-law contacted their local paper(OH)and was successful. In the obit they failed to mention his wife, children, etc. We have contacted the paper and they stated that they could not remove the obit or the guestbook posted at Legacy.com(IL) because it has already been paid for. Do we, as the legal next of kin, have any hopes of removing or editing the obit or guestbook. We have tried to sign the guestbook, but Legacy will not post. We simply would like to honor our father, as his wishes were to not have anything posted in any newspapers. It is hard enough dealing with the loss of a loved one, but it is harder when distant family interferes and confidentiality is broken. Do we have a ''legal'' leg to stand on and if so what steps do we take?
