Can I leave my home to my family member and not to my husband when I pass away?

You can, however if you wait to transfer after your death and it is a probate asset, your husband may elect to take against your will and get his statutory share. If that happens, the value of the house could be counted towards fulfilling that amount. A better alternative is to execute a transfer on death deed to the person or persons you want the house to pass to. You can keep the house in your name alone until your death.
