Life Estate

This on behalf of my aunt in Ohio:

My son was given an instrument providing that he receive all of my assets upon my death with the stipulation that I retain life estate. Son died without recording this instrument. I am still being billed as owner of properties. What is status? I should like to retain property and make my own will.

If the deed granting you a life estate and your son a future interest was never recorded, then the last recorded need is the one that counts. It sounds as though you are still the full owner and you can decide to determine what you want to do with it, whether through a will or new deed.
