What makes a will legal and binding?

If the deceased leaves a handwritten will that is signed by two witnesses (one being a notary) and is notarized is it binding? If their spouse passes away a few years later and does not leave a will, does the first will take precedence?

A handwritten will is known as a holographic will. It is valid. I'm unclear why this will would have a bearing on another decedent(dead spouse). I would need to see the will and hear the other facts. For more info, please contact my office at (248)851-3171.
