Legal Question in Wills and Trusts in Ohio

non probate of estate

Received 2 refund checks from insurance companies after Mom's death. Checks are payable to ''Estate of=====''. How can checks be cashed without having to probate a small estate?

Re: non probate of estate

If the amount of the checks or the entire sum of your mom's estate are below the filing limit, you should file a 'release from administration' with probate court. You can pick up the forms there.

You will probably need to do a release from administration from the probate court. It still requires filling out a bunch of forms, but is still fairly easy. Then you can open a bank account in the name of the estate and cash the checks.

If you are in the Columbus or Cincinnati area call our office for a free consultation.
