pension benefits

my mother passed away in 2005! My stepfather then in herited one half of my mother's pension. In 2006 he passed away and his estate is currently going to be claimed insolvent. After some research, I recieved a letter stating that I am now the beneficiary of her pension until its experation in 2010. Can the lawyer of my stepfather's estate lay claim to the remainder of the pension fund for his estate settlement?

If your mother named you contingent beneficiary, the pension is yours. Assets with designated beneficiaries are not subject to probate administration.
