pre-nup agreements

If an older couple sign pre-nuptual agreements, and one dies, is the other entitled to half of the other's total estate, or just half of what they earned together while married. in other words, one has life insurance policies, stocks, investments and such, and they pass, can the other claim half of the total, or is the pre-nuptual agreement legal and binding in this kind of case.

The conditions of the pre-nup would govern unless any of the conditions are found to be illegal in some way.
