Quit Claim Deed

My brother and I were named on a Quit claim Deed when my mother died. Does the property go directly to us or does it become part of the estate in Probate? The peoperty is worth about $115,000.00.

I am presuming the deed was never recorded. If it was, you already own the property. If the deed was signed and delivered by your mother to someone to record, and it never got done, the deed needs to be recorded. If the deed was still in your mother's possession when she died, it could be evidence that she did not intend to deed the property to you. You need to discuss the actual facts with your attorney.
