Legal Question in Wills and Trusts in Ohio

Release From Administration

Father passed away. In will, I am named as executor and sole beneficiary. Not enough assets for need of will to be probated. Summary Release from Administration granted by Probate Court. I have received checks made out to deceased father, but bank won't cash them. Since Release from Administration has been granted, is there anything I can do to cash these checks?

Re: Release From Administration

You are going to have to go back to the probate court and get authority to cash the checks. You should be able to accomplish this without a full application for administration of the estate. It may be as simple as asking to amend the application for a release of assets-or it may be more complicated, depending on the size of the checks and the status of the original release.
