Legal Question in Wills and Trusts in Ohio

What rights do I have?

I lived with my boyfriend for 3 years, on December 8, 2003, he passed away, leaving no will. Now, his ex-wife is making my life miserable by wanting me to move out of the home we shared and she wants me to leave everything. We shared in the cost of everything we had. She claims she is doing it on behalf of their 17 year old daughter who only saw her father 3 times in 8 years. I have no problem with moving out but do I have the right to take our personal possessions?

Re: What rights do I have?

There are a lot of "what if's" in your question. Your boyfriend's property will need to pass through probate, where many of your rights will become much more defined.

His ex-wife's demands aren't much more than empty demands until the court orders the distribution of property. If your boyfriend owned the home that you lived in together, it is likely that it will pass on to his daughter, but his ex-wife will have to take care of guardianship proceedings to handle the property for a minor. The personal property (household goods)will be the wild card and the more difficult question to answer. You should find a local attorney for some confidential advice on that issue.

I read Mr. Brumbaugh's reply, and I agree with him.
