Legal Question in Wills and Trusts in Ohio

Sibling Rights

My mother passed away in July without a will. One was drafted, but not signed before her death. I have a copy of that draft (I realize it is not worth the paper it is written on) which stated she wanted my brother to have a life estate in the property she and my father owned and lived in. Dad's own draft says exactly the same but, again, was never signed. My Dad has been diagnosed with the early stages of dementia (still not mentally incompetent by far)and a sister has stepped in and placed him into an Alzheimer's Care Facility after bullying him into going. This sister is now terrorizing my brother by coming into the home at all hours of the night, slamming things around, screaming obscenities and carrying personal property belonging to my parents out of the home. He changed the locks on the advice of both the police and legal counsel and the police have barred her from the property. I know this will only be a temporary solution to his situation, but since this situation has angered her (she is a very emotionally disturbed person), can she prevent the remaing siblings from visiting our father in the nursing home? There are six siblings and she is the only one who simply cannot get along.

Re: Sibling Rights

You don't say on what grounds your sister is trying to bar you from visiting your father. From what you have said I don't see any reason you wouldn't be allowed to visit him.

I suggest calling the facility for more information and to voice your concern.
