Legal Question in Wills and Trusts in Ohio

Simple Will

My Father passed away at the age of 80 this year. My Mother and him had a simple will transfering all to the surviving spouse. Does my mother need to do anything with the will?

Does it really need to go to Probate Court?

It depends on what assets your dad had. If you need to transfer assets from your dad to your mom, then you will probably need to open an estate with the probate court. The first step would be to contact a local attorney who is experienced in probate law.

If everything is joint tenancy with right of survivorship, then probably not. If however, you need a court order to transfer assets from husband to wife, such as stocks, real estate, or other property, then you need to contact an attorney, and open an estate.
