Legal Question in Wills and Trusts in Ohio

do spouses get all

my mom died. she is married for four years. he is not our biological father. she did not list any beneficiaries on any of her policies and there is no will. do the insurance companies get to give all the money and belongings to him without considering she have biological adult children living who would be entiled to the share before issueing the check?

When no beneficiary is listed in a policy the proceeds go to the estate. If there is no will the assets are distributed in accordance with the laws of intestacy. When there is a surviving spouse and surviving children there is a sharing of the proceeds from an estate. I suggest you contact a lawyer in the county where the decedent lived and start there.
