Legal Question in Wills and Trusts in Ohio
Can I go to Staples and get a form for a Will and have it signed by 2 witnesses and get it notorized or do I have to see an attorney to get it setup. My husband and I live in Ohio and we have not
children so our will would be simple, if I die he gets everything
if he dies I get everything. If we both die it would go to my
sister. How do I go about getting a proper will done if I want to
do it myself.

Ohio Wills are not notarized, just witnessed. Yes you can get a form and do it yourself, or draw up your own. However, with the many changes in the last few years, it may be well worth consulting with an attorney to plan your final affairs, to include a will. You may end up with a will, but through the advice of a knowledgable attorney and your particular facts, it may be best to have your assets pass outside of probate. Thereby potentially avoiding the expenses of probate altogether and the will never even being used.
In short, there is often more to planning for your eventual passing than most realize. I see many clients opening up and incurring the expenses of a probate estate, that they could have avoided by using some of the estate planning tools available, many of which have been out for just a few years.
