Suing fiduciary for bond

If the fiduciary

knew the deceased had surviving immediate family,and settled the estate without a will.

Can they be sued for withholding this information from their

attorney?Deceased persons daughter is beneficiary of a valid

will.

If a fraud was perpetrated on the court and beneficiary by the fiduciary appointed which resulted in monetary loss a claim can be made on the bond.
