Transfer of automotive ownership after a death

Hello all,

About a year ago my brother died. His car is sitting on my mothers property and has been since his death. My question is how can my mother go about having the title transferred to her name so she can sell the car. She went to the local title office, but all they would tell her is that the title office must have a court order to issue the title in her name.

Any help or comments would be welcomed and apperciated.

The legislature just passed a new law that might help presuming that the only asset you are talking about is the car. There is a "summary administration" of the estate(ORC 2113.031). This can be done at the probate court in the county in which your brother died. Once you get this court order, the title company will gladly transfer the title.
