Legal Question in Wills and Trusts in Ohio

Trusts in a will

I am trying to do a simple will online. I am divorced and have one child, age 15. I want to leave everything in a trust for her. Would her father have access to it if he claims he needs it to help support her? He has a good job and wouldn't need it.

Indicate in your will the person and alternate you would like to manage the trust.

Re: Trusts in a will

You need to be very careful about the language in the trust especially if it has a support provision. If funds are available for her support then he could reach them.

What you are trying to do is very complicated and I would respectfully suggest that an online form will probably not accomplish your goals. I would at the very least consult with an estate planning attorney to review your online document and make sure it accomplishes your wishes.

You should also be aware that a trust in a will requires ongoing probate administration.
