Legal Question in Wills and Trusts in Ohio

Unable to recieve Mother's monies.

My uncle and I are trying to get my deceased mother's monies and stocks from the state of Ohio. They told us to get a lawyer, we will be sending more money than it is in the account.

No one is required to retain an attorney to handle a probate, however, it does make it easier for you since they are familiar with that process. If you want to handle this on your own the best information that I can give you is if your mother had any asset in her name only then Probate is required. If that account is in your mother's name only with no beneficiary or joint onwner, then you are required to file the original Will and the other appropriate documents with the court to begin this process. I do not recommend that you handle this on your own, it can get very complicating and frustrating. Plus you are dealing with the loss of your mother and this added stress will only upset you further.
