Legal Question in Wills and Trusts in Ohio

will modification to include grandchildren

My will currently leaves everyting to my only daughter. The paragraph following this bequest, states that ''should she not have had children at the time of my death'' then goes on to request specific allocations of other relatives.

Can I assume the above statement means : my daughter will get everything, or if she does not survive me, then my grandchild(children) will share everything equally? Of do I need a will modification to direct $$$ to my grandchildren in that event.

Re: will modification to include grandchildren

It is difficult to tell without seeing more of the language. In the bequest to your daughter, it should say something like, "To my daughter, or if she predeceases me, to her lineal descendants, per stirpes." If something like the above, then it will go to your grandchildren if your daughter predeceases you. If you want us to review the language, you may mail us a copy or fax it to us.
