Legal Question in Wills and Trusts in Ohio

Wills

I found mother's and father's wills dated 1991. My father left everything to my mother. My father has since passed away. My mother made out a new will 07/12/2005. What should I do with these wills. Can I get them probated without hiring a lawyer?

Re: Wills

If your father's name is left on any asset, then you will need his will to file in the Probate Court. If he is not on any asset, you can file it "For Record Only" if you like. Your mother's will does not need filing until she passes away. I would hold onto both originals (unless you file your Dad's will now)until your mother's death. I would consult with an attorney at that time to see how much you can do and what would be best for the attorney to do.
