Wrongful Death of my 9yr old son and my rights therein

My 9 yr old son drowned at his friends birthday party.

He had not heard from his father in over 1 year. Now that he has passed there are settlements that are being handled, however I have been made administratix over my sons' estate(the settlements). I do not feel that it would be morally right to give his father a portion. My question is As executor of my sons' estate,do I have the right to stop his father from recieving a share based on his non-responsibility to care for his son?

The Court will insist that you attempt to contact the father to let him know about the proceeds of the case. However, you can deduct from his share of the settlement the child support payments he should have been paying.
