Legal Question in Workers Comp in Ohio

further compensation

i did have a question, but it got erased i guess, so anyway. i was injured on my job three months ago. my benifits are drastically low, almost nonexistent. now, after an mri was given, its been found i need surgery. is there any way i can sue my job, at least for pain and suffering? my attorney has already let me know its really menial, and its beneath him even to consider talking to me, except to embarress me. please,if you can give me some kind of answer, it will be appreciated. thank you for your time and patience, and

When you get hurt at work, you come under the Workers' Compensation laws of each state. One thing that is consistent from state to state is that you CANNOT sue your employer AND you cannot claim pain and suffering. Beyond that, the Workers' Comp laws do vary somewhat from state to state. I'm in Illinois. So, I can't tell you much about the laws of Ohio. You either have to trust the attorney you have or get another lawyer who is familiar with the Work Comp laws in your state. Good Luck!
