I have been denied treatment for a work related injury because the doctor accuses me having back surgery in 1990 and I have never had any surgery. when I told the doctor that they have someone else's records she said I was liar and she stands by her finding's. I have proof she has the wrong records but she still will not investigate or take the time to see I am right. Instead she keeps refusing me needed treatment and continues to call me a liar. Do I have grounds in which to sue her?

You may not have grounds to sue the doctor but you do have a right to needed care and if you can not get it with the current doc then you need to get another doc. A worker's comp atty should be able to make that happen-at no cost to you!
Most Worker's comp attys will work to make sure the proper injuries are allowed and that you get the proper medical care. Their fee comes from a percentage of lumpsum payouts that you receive because of their efforts.
If you have a back problem that requires surgery you should be represented by an attorney. You can not count on the "advice" that the Co. doctor or even the representative for the Company Worker's Comp Plan provides. This is too important to not have a representative who you know is on your side.
