Legal Question in Bankruptcy in Oklahoma
Bankruptcy
We filed bankruptcy and it has been settled for almost 2 years. My question is if a creditor can tell you to surrender the merchandise that they financed and take legal action against you if they did not say so at the time. The did not come to our hearing or say anything at the time before it was closed.

Re: Bankruptcy
If a debt was not reaffirmed in the bankruptcy that was secured by collateral, then the creditor can ask you to turn over the collateral and if you don't, they can file a lawsuit for replevin of the collateral. If the collateral is not worth much, the creditor usually threatens to sue, but does not actually go through with it.
