Legal Question in Bankruptcy in Oklahoma

child support and bankruptcy

I am involved in a child support case. I am the custodial parent. The ex owes $51,000 in past support and interest. The Department of Human Services Oklahoma placed $24,000 with a collection agency and my ex filed bankruptcy in 2001 and claims he has cleared this obligation and does not owe this support. Is this allowable in bankruptcy law on an active child support case? The boys did not come of age until 2008?

Child suppport cannot be discharged in a bankruptcy action; it is possible the interest could be discharged. The collection agency should have gotten notice of the bankruptcy. All the best on getting what is owed to you. You may need to see an attorney regarding your rights to collect the support yourself; your local DA may also be able to assist you.
