Can I file without my husbanc

I have 5 bills that are in my name only. I lost my job and in order to keep our house and car I need to file bankruptcy on my debts. 2 of the loans are secured with household items. I listed a tractor that cost around 4,000 when new (about 3 years ago). I had every intention of paying these loans. I had no idea I would loss my job. I told the finance company the tractor belonged to my husband and not me, they said that was okay. His name is not on these loans. Will the finance company take the tractor.

Thank you for your question. You can file a personal bankruptcy without your husband also filing. As for the tractor, since it was purchased and financed in your name only it will most likely be taken if there was a security agreement covering it. If it is unsecured you will most likely be able to retain it and the debt will be discharged. Further, you should be careful not to make any false statement in the bankruptcy filings as there can be severe consequences.
