Foreclosure-Writ

We filed Ch.7 bankruptcy on a Monday, and were served a writ for eviction to be out of our trailer on July 1. Do we have to be out by that time? Or does our bankruptcy stop all that?

Thank you for your question. A stay order was entered at the time you filed and if you listed the landlord as a creditor the landlord will receive notice of the filing and stay order. The landlord should then stop efforts to evict you and seek relief in the bankruptcy case to either lift the stay or for adequate protection from you concerning rent payments. When you indicate notice of eviction was served, I dont know whether you are referring to a court filed document or simply a written notice from you landlord. If there is a court filing, I would file a copy of the Notice to creditors in the court file. You should also consider having your attorney mail a copy with cover letter to the landlord as additional protection.
