Question about home loan debt

If I were to file Chapter 7 Bankruptcy, would my credit union, who I have my home mortgage through, be able to take the home from me if I want to keep paying for it after the bankruptcy?

You actually have two choices: the first is to keep paying for it. However, the day you are late with a payment, you are out on your ear and have no right to any equity.

Choice two: Reaffirm the debt. To do this in a 7, your payments must be current. Then it is just as if you never filed the 7 for that creditor.

Bottom line: If you are behind in your house payments you have a problem. However, if you are up to speed and want to keep the home, then reaffirm the debt.
