To create a business in Oklahoma, go to Secretary of State website, get the forms, follow the instructions. You can do a name search on the website and, if Duct Doctor is not there, you can form your LLC with that name. That doesn't mean the Duct Doctor USA can't come after you for trademark infringement. If they do, it's a federal issue, and you may have a problem; they could sue you in federal court. You'd have to argue you're different enough, which may be tough with the same name.
