We purchased a bar bq cafe 6 years ago, with the condition that the seller would not go into business for 2 years in our county. He was in my employment for about a year after failing in his restaurant venture in another county. He has now come into town
and is serving the same menu at
his place as I have; prepared the same... Now that I read this it sounds like I am drawing for straws.
It just doesn't seem right. Let me know. Thanks.

This would be a difficult question to answer without more information because there are several questions that need to be answered. For instance: Did you employ the seller as a general partner? Did he/her have a franchise? Did you complete a legal limit liability partnership agreement? Did the seller protect this menu as proprietary or intellectual property? Did the seller sign a conflict of interest or failure to disclose at time the property was sold or he/she was hired to work for you? Without more information about the "conditions of employment" or "conditions of sell" we cannot provide an infinitive answer to your question.
