The non profit 501 (c) standing is an Internal Revenue Code standing.

Name of an entity is obtained in Oklahoma through the Oklahoma State Secretary of State.

If you have registered your organization there, then call their office or go to that office and follow their procedure on filing a complaint.

The answer this question would depend on whether you followed legal statutory procedure by filing your non-profit corporation with the Secretary of State (SOS). If you filed with the SOS, the state has a responsibility to do a name check before accepting your filings. It is apparent that you or the other organization didn't file and register ownership of this name and whoever did NOT file is using the name illegally.

Note:

This is public information so a name search was conducted. This organization is registered to Mark Fritts and it was filed as a non-profit in 1994. If you are this person you have sole ownership and use of this name and it cannot be used legally by any other entity.
