Legal Question in Business Law in Oklahoma
I am the office manager for a counseling firm, (LPC), and we want to put an addendum in the therapists contracts that they cannot work for another agency within 50 miles of our agency upon termination. Also, we want to put in place an addendum that they cannot take clients with them who are established through our agency referral system upon leaving. I am not really sure what area of law this would pertain to.
Thank you for your time.

Oklahoma courts generally disfavor non-compete covenants, however such clauses can be properly worded to give you a reasonable chance of having them upheld. Legal authority for such clauses is found both in statute and case law, and to give yourself the best chance of crafting enforceable language you need to understand both. I would not recommend doing this without a lawyer's advise because the law in Oklahoma is fairly specific and developed on the subject, so it's not a simple cut/paste operation; rather, getting an attorney to review your existing agreement and make modifications is, in my opinion, your best option.
