Legal Question in Business Law in Oklahoma

PS3 incident

I recently purchased an 80G Playstation 3 from Wal-Mart. Wal-Mart was offering a special promotion, and an electronics associate explained to me that for purchasing the PS3, I would also receive10 free Blu-Ray disc movies. What a deal!! ... I thought. I later discovered that to enjoy the movies, they had to be played through an HDTV, which I don't have, so I exchanged the new movies for other merchandise. Being as I used the (promotional merchandise) --WHICH I THOUGHT WAS FREE!!-- for personal gain, I was terminated. It was simply a lack of communication on the company's behalf, and a misunderstanding on mine. I feel that I was wrongfully terminated here...what are my legal rights? Do I not have the rights to sell or exchange property that I hold title to?

Re: PS3 incident

The first question is: Did they provide a disclaimer or disclosure outlining your rights and an agreement was included in the transaction. Particularly one forbidding the sell of the merchandise? Was there such an agreement? If yes, did you read and/or sign the agreement?

Secondly, did you inform them of your intent to sell the merchandise prior to this action? Did they try and induce you into purchase the additional equipment?

Finally, did they inform you of the need to purchase other equipment prior to offering the movies?

There are alot of questions that need to answered before we can issue a definitive response to your question.

If none of the above had taken place, there is a serious concern that you were not treated fairly and you may have cause to take action.

The bottom-line is whether or not you were made aware of what you were agreeing to and whether you fully understood your responsibilities prior to the termination. I hope this helps.
