rejected shipment of produce
I have a one truck operation, I took a load going from texas to boston, the driver set the temp. wrong the load was rejected I called the broker he said put the produce back on the truck and take it to another place where they would sell it, my question is the produce sold for less than what they would have got at the first place, now they want me to pay the difference, they did not inform me of this till 2 weeks after it happened, my insurance wont cover the loss, is the broker responsable for this load because he is the one who had me put it back on the truck and take it someplace else, they are asking for $22,000. 00 I was not paid to haul the load eather.

The broker should have insurance and if the problem resulted from the actual transfer it is the broker in default. Unless you signed a contract stating that you are otherwise responsible for any damages or lost as a result of alternations or changes in the transport of this produce, it looks like responsibility for the negligence or mishap rests within the confines and the authority of the broker who directed you to another location.
