Re: solicitation

No. The hand outs would be legally defined as a form of "charity." Charity is aid given to the poor, suffering or the general community and it is a form of goodwill. And,if and only if, no profit or benefit is received by the giver. Additionally, this act of giving should not be conveyed as a conflict of interest unless something is expected and given in return.

However,if the company you work for is giving the food it would be considered a "charitable contribution." Under such conditions they (the company you work for) may prefer giving to a qualified charitable organization or tax-exempt organization for deductible tax purposes.

Either way, this particular act is not considered a solicitation because there are no offers to pay or accept money or favors in exchange for the food or act. Or, you are not seeking to obtain something. However, you must be careful to assure your employer is aware of the situation so that this could not be contruded as bribery or other conflicts that put your character and reputation in question.
