Trademark
If a individual is using a domain name that consists of my registered trademark name, what do I do to gain possession of the domain? or can I? I have the legal right too? How do I approach them to avoid a lawsuit, or does the person not have a right to sue?

If the trademark used is legally registered. You have the legal right to take action. And, you have the right to protect the trademark under any and all circumstances.
The question whether the tradename is protected as well. If not, it is recommended that you register this name before you attempt to use it or protect it as a domain name.
