Legal Question in Civil Rights Law in Oklahoma

School Student Interrogation

My child and one other student are being accused and punished for stealing money in school when there is not solid proof they did it. They did lie during questioning but they admitted to the lie. They are being condemned on very shaky and faulty circumstances. The kids will admit they lied however do not admit to being theifs and have no prior discipline records as well. My son is an honor student and has been a long time. My son was questioned for almost an entire hour after school by the asst. principal. He requested to call me (his mother) to bring me in for this. The school refused his request then called me to say they were supsending him and why. The principal said that he hoped he was wrong and he was falsely accusing them and that they did not do it. However, because they lied he was punishing them for it anyway. I think the entire deal is raw and I want to know if the school has the right to question my child in a case like this without me being aware or present?

Re: School Student Interrogation

If your child is being questioned for a crime, it is recommended to have the parent or another adult witness present on his behalf.

However, lying is also a crime under such conditions. I wish I could better answer your question but this is the only response I can give based on the information provided. Hope it helps.
