Legal Question in Technology Law in Oklahoma
Is it illegal to post our babies' bath pictures on our personal blog(not password protected), or on Facebook?
1 Answer from Attorneys
This is a question of criminal law, since it is your baby. The question is whether the pictures are considered pornographic and whether any state attorney would prosecute you for them even if they technically might be considered pornography. I think it is extremely unlikely they would be considered pornographic by the average Oklahoman if the "baby" is an infant and even less likely that there is an Oklahoma prosecutor that would spend his time charging you with publication of pornography over babies' bath pictures. However, the precise answer is that they probably are technically illegal, even though their publication on Facebook is probably without serious legal risk. Now, if the "baby" is an adolescent or teen or older, you could be in serious trouble for doing this.
