Legal Question in Constitutional Law in Oklahoma

General Quick Questions

I only have a few questions...They have to do with bribery , fraud, and issuing false documents.

What is the penalty if an official of the court accepts a bribe in State and County courts? If they issue false documents?

One more..What might happen to legally appointed representatives for abuse of power of attorney, forgery, misrepresentation and fraud?

Re: General Quick Questions

Unfortunately your questions, as posed, don't provide me with enough information to help you.

Bribery of a state official would be both a state felony and a federal felony as well. These crimes would fall under the jurisdiction of the FBI, and the FBI investigations official corruption. As to the penalties, they are set out in the various statutes, but as to what penalties would apply, and even what statutes would apply, I would need to know more facts to help you with this question.

If a person were appointed as power of attorney and they engaged in misrepresentation and fraud, the principal (the person who appointed them) would have to make good to the person defrauded. That principal would then have a cause of action in civil court against them for breach of fiduciary duty arising out of that fraud.

There might also be criminal charges filed as a result of the abuse of a power of attorney if the fraud involved forgery or false documents.

Because there are so many possible answers to your problem, I regret I am unable to provide more definite assistance.
